Increase in taxes on fuels is suspended again

The Federal Court in the Federal District suspended again the last Friday (18) the adjustment of the rates of the Social Integration Program (PIS) and the Contribution for the Financing of Social Security (Cofins) on gasoline, diesel and ethanol, Announced by the government last month. The decision was handed down by Judge Adversi de Abreu.

Last month, in another ruling, Judge Renato Borelli also suspended the readjustment because he thought it would be unconstitutional because it was done by decree and not by a bill. Then the decision was overturned by the second instance of the Federal Court. The decision was handed down by Judge Hilton Queiroz, president of the court, who heard an appeal from the Federal Attorney General’s Office (AGU) against the suspension of the readjustment.

The government’s forecast is to raise more R $ 10.4 billion with the increase in PIS / Cofins on fuels, so as to be able to meet the fiscal deficit target of R $ 159 billion for this year.

By way of note, the AGU has informed that it has not yet been notified of the decision, but is already analyzing what measures will be adopted.
